Italy: Human Decision-Making in AI-Assisted Employment Decisions (Article 41, Legislative Decree No. 179/2026)

ItalyLegislationEnacted, upcoming

Article 41 of Italy’s Legislative Decree No. 179/2026 regulates the use of AI systems in decisions affecting employment relationships in Italy. From 23 October 2026, employers using AI in decisions to establish, change or end an employment relationship, including disciplinary decisions and performance evaluations, must ensure the final decision is not taken solely through automated processing. A person with effective and independent authority must make the definitive decision, and worker consent does not create an exception. Employers must also meet existing information duties before processing begins and, on request, give a worker an intelligible explanation through a person, including the AI system’s influence and the main parameters considered. Decisions made in breach of the human decision rule are void. Article 41 does not set a bias audit or testing requirement. It also does not treat candidate search and selection, including a decision not to admit someone to a later stage, as a final decision for this rule. It preserves GDPR Article 22.

Impact

What this means for HR and vendors

HR and recruitment teams

HR teams may need to confirm that a named person with real authority makes and can change every final decision on hiring, changes to employment, discipline, performance evaluation and dismissal when AI is involved. Organizations should ensure managers can explain how an AI system influenced a decision and which main parameters were considered, and that worker information duties are met before processing begins. This increases the importance of documenting human review. Early-stage candidate screening is treated differently, but other EU and Italian requirements may still apply.

HR technology vendors

Article 41 places its duties on employers using AI systems and does not impose direct duties on HR technology providers. Providers may nonetheless face commercial and compliance expectations from Italian customers. Customers may need tools, documentation and explanations that let a human reviewer exercise effective authority, understand the system’s influence and identify the main parameters considered. Providers should not assume that supporting these customer needs creates or removes any direct legal liability.
