We built this for HR leaders, talent acquisition teams, technology vendors, and risk operators who need to cut through the noise of emerging policies and understand exactly what these shifts mean in practice. Our objective is straightforward: to provide a highly practical, evidence-led tracker for workplace algorithmic governance.

What The Warden Watch Covers

This tracker focuses on automated systems, algorithms, and machine learning models that directly or indirectly influence employment lifecycle decisions. This includes candidate sourcing, screening, psychometric or skills assessment, promotion tracking, productivity monitoring, performance evaluation, and termination.

Our initial tracking framework prioritizes active statutory regulation and high-impact litigation. As the policy landscape shifts, coverage will expand to capture broader enforcement trends, localized administrative incidents, and evolving state and federal frameworks.

How We Build the Tracker

The Warden Watch records are developed through source-text review, standardized data extraction, and human legal-risk analysis.

We rely on official, primary sources: statutory text, regulator guidance, official government white papers, court dockets, and formal enforcement briefs. While we monitor secondary legal commentary and reputable academic analysis for context, we do not use commentary as a proxy for the underlying legal or regulatory text. For every record, our team verifies applicability to workplace systems, extracts operational requirements, and translates complex legal text into direct, plain English.

How We Categorize Obligations

To make the tracker actionable, we break down regulatory text and case law into specific obligations and operational controls. We deliberately avoid dense legal jargon, using standard labels to denote the operational weight of a development:

  • Mandatory: Explicit legal or regulatory requirements directly imposed by the source text.
  • Expected: Clear regulatory or administrative expectations derived from official guidance, enforcement histories, or broader statutory duties.
  • Recommended: Practical governance actions or technical controls that help mitigate risk or demonstrate compliance, though not explicitly mandated by the source text.
  • Optional: Voluntary compliance frameworks, industry standards, or non-binding best practices.
  • Informational: Material that offers necessary operational context but carries no direct action requirements.
  • Unclear: Scenarios where the source text or regulatory body has not yet defined the precise level of requirement.

Our Methodology

Because employment AI regulation is in its infancy, our analytical approach is intentionally conservative.

We do not label an operational control as mandatory unless the underlying source explicitly requires it. We maintain strict distinctions between binding statutory law, non-binding regulator suggestions, and general industry risk-mitigation strategies. Similarly, when tracking litigation, we explicitly distinguish between unproven allegations, legal arguments, voluntary settlements, procedural dismissals, and final, binding judicial findings.

When a law or regulation applies broadly across multiple industries, we filter the noise - summarizing only the provisions that impact hiring, human resources, or workforce management.

Current Scope & Limitations

The Warden Watch is a live, evolving dataset. It does not claim to contain every jurisdiction, local ordinance, pending bill, or historic legal precedent. We update records continuously as new regulatory guidance emerges, cases move through the courts, or our coverage expands to new regions.
