
Warden AI recently hosted a briefing to explore the practical reality of California's new Automated Decision-Making Technology (ADMT) rules.

The industry is heavily adopting AI, but identifying exactly which tools trigger regulatory obligations is becoming difficult for both buyers and builders.
Ram Gudavalli noted that while some tools are purely assistive (like generating job descriptions), others cross the line into significant decision-making, such as scoring or ranking candidates.
He highlighted that the distinction is not always apparent, describing modern recruitment tech stacks as a "soup" where basic automation easily evolves into high-risk processes.
Resume parsing is a great example of this. I mean, ATSs have had integrated resume parsing for decades... but now that it's so natural and integrated and useful, it's very easy to then add a rule, add an automation that says, okay, these are the resumes I want to be able to do X, Y, or Z with... and that's where, now, in this new landscape, you have to really think about... what does it mean to introduce those types of processes within your recruiting funnel.
A recurring theme was that compliance is as much an organizational change challenge as it is a legal one. Liisa Thomas introduced the concept of POSIWID - "The purpose of a system is what it does."
She explained that if a system doesn't allow for human intervention, or if a recruitment and staffing team's metrics reward recruiters for bypassing compliance in favor of speed, the organization will naturally produce non-compliant outcomes.
We sometimes sort of let go of asking those critical questions... Can it [the system] only result in a bad outcome?... looking at the system to avoid accountability syncs and the system running the decision, so try and have good POSIWIDs, not bad POSIWIDs.
When discussing how to handle candidate opt-outs, the panel advised taking a step back and evaluating the business process as a whole. Both speakers emphasized the need for a "pre-mortem" approach.
If the third-party AI tool your recruitment and staffing team relies on fails, or if a candidate exercises their right to opt out, you must have a functional, manual workaround prepared.
Liisa mentions,
I can promise you that there will come a time when the system, this automated technology computer system that you're relying on isn't going to work... let's presume it fails the system that we're relying on. What would we do in the absence of that system?... If we don't have a workaround, that means that we're not engaging in those business practices.
As recruitment and staffing teams increasingly act as "product managers" configuring highly adaptable tools, the question of liability becomes complex. Ram emphasized that managing this risk requires a shared responsibility model between the HR tech vendor and the buying organization.
He advised recruitment and staffing leaders to demand clear documentation regarding how algorithms function and what data they use, while noting that vendors must build transparency directly into their UX.
From the vendor side, it's critical that we provide transparency around things like the documentation. Related to what data is used, how that data is used, algorithmically or through AI decision making... Providing tools, so it's easy for candidate requests to fix or update data can propagate through.
During the Q&A, an attendee asked if using a "specialized HR system" automatically exempted them from providing opt-outs under a specific CCPA clause. Liisa cautioned against jumping to conclusions, noting that the law has multiple, stringent conditions that must be met to claim such exemptions.

As Liisa provided as a final piece of advice for all leaders navigating this new era of compliance:
Don't rush to a solution. Be comfortable with sitting with the problem for a little while. So, we have a lot of pressure to come to solutions... it is going to create a better solution if you sit with the problem a little bit.
To successfully operationalize these rules, recruitment and staffing teams need to map their current tech stacks, categorize the risk levels of their automated tools, and partner closely with their HR tech vendors to design compliance workflows - like opt-outs - as a core principle of their operations.
With the right mix of organizational change, vendor transparency, and strategic foresight, navigating California's new AI rules is completely achievable.
